Indaba Trading Ltd. is committed to protecting the privacy and security of your personal information obtained by reason of your relationship with Indaba.  This following privacy policy explains the types of personal information we collect, how it is used, and the steps that we take to ensure the privacy of your personal information is appropriately protected.    

Our policies and practices have been designed to comply with the Personal Information and Electronic Documents Act (PIPEDA) and corresponding current provincial privacy acts.

What is personal information?

Personal information is information that refers to an individual specifically, and includes information recorded in any form. Personal information includes things such as unique identification numbers, email addresses, phone numbers, and financial data.

What personal information do we collect?

For customers, information may include bank information, contact name, credit card numbers, client name, address and contact information, or other details to help you with your experience.

For employees, we collect information such as employment and education history, medical/ spousal information for benefits plans, social insurance numbers for government filings, photo ID for legal and filing purposes, banking information for payroll or financial transactions, activity logs, and performance evaluations.

For consumers, we may collect information related to product feedback.

When do we collect information?

 We collect information from you when you register on our site, place an order, subscribe to a newsletter, fill out a form or enter information on our site.

How do we use your information?

 We may use the information we collect from you when you register, make a purchase, sign up for our newsletter, or respond to a survey or marketing communication in the following ways:

  • To personalize user’s experience and to allow us to deliver the type of content and product offerings in which you are most interested.

  • To improve our website, and better serve you.

  • To allow us to better service you in responding to your customer service requests.

How do we protect visitor information?

The security of your personal information is a high priority for Indaba.  We maintain appropriate safeguards and security measures to protect your personal information, whether recorded on paper or captured electronically against unauthorized access, disclosure or misuse, including;

  • Electronic security measures for computerized personal information such as password protection and encryption where appropriate;

  • Organizational processes such as limiting access to personal information to a selected group of individuals;

  • All transactions are processed through a gateway provider, not stored or processed on our servers.

Although we cannot take responsibility for any theft, misuse, unauthorized disclosure, loss, alterations or destruction of data by a third party, we take reasonable precautions to prevent such occurrences.

How does Indaba obtain consent to collect, use and/or disclose my personal information?

Generally, Indaba obtains your consent to collect, use or disclose personal information.  The method of obtaining consent is appropriate to the type and sensitivity of the personal information being collected, used or disclosed.

In some cases, your consent is implied if we ask you to provide personal information with a stated purpose.  In other cases, we will ask you to give your express consent to collect, use or disclose your personal information.

Does Indaba limit the collection of my personal information?

Indaba typically collects only the personal information required to provide our product and services to you.  If the personal information we require is collected for a reason other than to provide products and services, we will advise you of the reason and obtain your consent before or at the time the information is collected.

The following are some examples of why we collect your personal information:

  • To process any information and customer requests;

  • To add subscriber’s email to the Company’s database for information dissemination including but not limited to news releases or corporate updates;

  • To measure and improve the effectiveness of our Web Sites or our marketing endeavors;

  • To process any resumes submitted; and

  • To comply with the law

We may also collect and summarize subscriber information in a format that no longer identifies the individual for statistical purposes.

Does Indaba limit the use, disclosure and retention of my personal information?

Except as permitted or required by law, Indaba uses and discloses your personal information only for the purposes it was collected.

  • If the information is publicly available;

  • To assist in or coordinate product recalls; and

  • To conduct surveys and questionnaires.

Indaba retains your personal information only as long as it is required for our business relationship, or as required for federal and provincial laws, subject to reasonable industry practices for records retention.

Does Indaba keep my personal information up to date and accurate?

Indaba makes reasonable efforts to keep your personal information up to date, accurate and relevant for its intended use, however, we rely on you to update us with your information as it changes.

You can request access to your personal information to verify, update and correct it, and to have any obsolete personal information removed.Subject to certain exceptions prescribed by law, and provided we can authenticate your identity, you will be given reasonable access to your personal information, and will be entitled to challenge the accuracy and completeness of the information and to have it amended as appropriate.

You can also ask us to change your preferences regarding how we use or disclose your information, or let us know you do not wish to receive any further communication from us.

Cookies

We do not use cookies for tracking purposes.

Third Party Disclosure

We do not sell, trade, or otherwise transfer to outside parties your personal identifiable information for any reason; provided, however if Indaba or a substantial part of the business is sold or otherwise transferred to a third party, your personal information may be transferred as well.  We will notify you of any transfer of your personal information in connection with such a major transaction.

California Online Privacy Protection Act (CalOPPA)

The CalOPPA was drafted to allow for the protection of privacy rights and personal data of California residents.  Although a California law, virtually all websites collecting personal data online must comply with CalOPPA because of the probability that the site(s) could be used by a resident of California.

According to CalOPPA we agree to the following:

  • Users can visit our site anonymously.

  • There is a line to our Privacy Policy on our Home Page.

  • Our Privacy Policy link includes the word ‘Privacy’, and can be easily be found on the page specified above.

  • Users will be notified of any privacy policy changes on our Privacy Policy Page

  • Users are able to change their personal information by emailing us, calling us, or writing us (See “How Can I Contact Indaba?” below)

Children Online Privacy Protection Act (COPPA)

COPPA imposes certain requirements on operators, web sites, or online services directed to children under 13 years of age.  We do not specifically market to children under 13.

Fair Information Practices

The United States Federal Trade Commissions Fair Information Practice Principles are guidelines that represent widely accepted concepts concerning fair information practices in an electronic marketplace.

In order to be in line with Fair Information Practices we will take the following responsive action, should a data breach occur:

CAN SPAM Act

The CAN-SPAM Act is a law that sets the rules for commercial email, establishes requirements for commercial messages, gives recipients the right to have emails stopped from being sent to them, and spells out tough penalties for violations.

We collect your email address in order to:

      • Send information, respond to inquiries, and/or other requests or questions.

      • Process orders and to send information and updates pertaining to orders

      • Market to our mailing list or continue to send emails to our clients after the original transaction has occurred

To be accordance with CANSPAM we agree to the following:

      • NOT use false, or misleading subjects or email addresses

      • Identify the message as an advertisement in some reasonable way

      • Include the physical address of our business or site headquarters

      • Monitor third party email marketing services for compliance, if one is used.

      • Honor opt-out/unsubscribe requests quickly

      • Allow users to unsubscribe by using the link at the bottom of each email
